NATURALWISE WEBSITE TERMS AND CONDITIONS

GENERAL

When accessing this website https://www.naturalwise.co.za (‘Website’), you enter into a legally binding contract with Naturalwise on the terms and conditions (‘Terms’) set out in this document. Naturalwise cc is a business in the Natural health, wellness and greening industry that markets natural, healthy and environmentally friendly products. (‘Naturalwise’, ‘we’ or ‘us’ or ‘our’ as required by the context.)

These Terms apply to all visitors to the Website, including members of the public or legal entities accessing the Website for information purposes; members of the public (‘Content’); web search engines; and data and/or information aggregators (‘users’ or ‘you’ or ‘your’).

We are an online retailer providing top-quality products and equipment tailored for those who value health, wellness, and sustainability. (these products are collectively referred to as ‘Products) on the Website, and your access and/or use of the Website and the Products are subject to these Terms.

These Terms and the other policies posted on the Website (including the privacy policy https://www.naturalwise.co.za/privacy-notice) constitute the complete and exclusive understanding and agreement between us and you and govern your use of the Products and the Website. This understanding and agreement super cedes all prior understandings, proposals, agreements, negotiations and discussions between us and you, whether written or oral. The Terms and the relationship between us and you are governed by the laws of the Republic of South Africa. You and we agree to submit to the personal and exclusive jurisdiction of the courts located in Johannesburg. Our failure to exercise or enforce any right or provision of the Terms does not constitute a waiver of such right or provision. If any provision of the Terms is found by a court of competent jurisdiction to be invalid (because, for example, such provision is inconsistent with the laws of another jurisdiction) or inapplicable, us and you nevertheless agree that the court should endeavour to give effect to our and your intentions as reflected in the provision.

By accessing the Website and/or by using the Products (as amended and updated from time to time), you agree to be bound by these Terms. Should you object to any term or condition of these Terms, to any guideline or any subsequent changes thereto, or become dissatisfied with us, the Website or the Products, please refrain from using the Website and/or the Products.

These Terms may be amended by us at any time and at our sole discretion. We will publish notice of such amendment(s) on the Website.

CONSUMER PROTECTION ACT, ACT NO. 68 OF 2008

If these Terms (or any contract governed by them) or the Products provided and/or made available on the Website are regulated by or subject to the Consumer Protection Act, Act No. 68 of 2008, as amended from time to time, it is not intended that any provision of these Terms contravene any provision of that Act.

ACCESSING (BROWSING) OUR WEBSITE AND USING OUR PRODUCTS

The Website and the Content available through the Website may contain links to third-party websites (‘Third-Party Websites’) completely unrelated to us or our Products. If you link to Third-Party Websites, you may be subject to the terms and conditions and other policies of those Third-Party Websites. We do not endorse any Content displayed on any Third-Party Website.

DELIVERY POLICY

Subject to availability and receipt of payment, orders will be processed within 1 -2 days and delivery confirmed via email.

UNPAID ITEMS

Any items that have not been fully paid for within 3 months of the invoice or repair will be sold to defray expenses and no further claims may be made on Naturalwise cc after this date.

WARRANTY

Naturalwise cc does not make any claim on any product they sell further other than what the manufacturer states. There are no other warranties, expressed or implied, made on any item. Naturalwise cc does not sell or accept used merchandise; all mechanical problems fall under the manufacturers warranty.

RETURNS AND REFUNDS

The provision of goods and services by Naturalwise cc is subject to availability. Products are held in stock in South Africa. In cases of unavailability, Naturalwise cc will refund the client in full within 1-2 working days.

Naturalwise cc offers a 3 day money back guarantee on certain products provided that the goods are returned undamaged and unused in their original undamaged packaging. An admin fee of 10% of purchase price is charged on all returns. The return of the goods is at the clients own risk and expense.

Note that items that are manufactured to order (such as the WS range of water distillers) or items ordered in especially on order (including the Excalibur commercial dehydrators and all Harvest Right Freeze dryers) are non returnable and non refundable.

Spare parts are non-refundable and non-returnable.

If the product is found to be damaged or defective due to no fault of the customer, the item will be repaired or replaced. Any damaged or defective products must be reported to Naturalwise cc by the customer within 48 hours of receipt of the goods. We will collect and re-deliver the repaired or replacement item at our cost.

All warranties are between the customer and the manufacturer. Naturalwise cc does not imply any other warranty or guarantee on the products.

PAYMENT OPTIONS ACCEPTED

Payment may be made via Visa, Master Card and Mobicred or by bank transfer or direct deposit into the Naturalwise cc bank account, the details of which will be provided on request.

CREDIT CARD ACQUIRING AND SECURITY

Credit card transactions will be acquired for Naturalwise cc by Payfast who are the approved payment gateway for Naturalwise cc. All credit card transactions are 128 bit Secure Socket Layers – SSL – encrypted. The company registration documents and the sites registered domain name are checked and verified by Thawte, ensuring the cardholder and merchant that nobody can impersonate Payfast to obtain confidential information.

Payfast is committed to providing secure online services. All encryption complies with international standards. Encryption is used to protect the transmission of personal information when completing online transactions. Payfast Internet servers are protected by firewalls and intrusion detection systems.

Naturalwise cc does not have access to credit card details. Payfast continually reviews and enhances its security in line with technological changes.

CUSTOMER DETAILS SEPARATE FROM CARD DETAILS

Customer details will be stored by Naturalwise cc separately from card details which are entered by the client on Naturalwise cc secure site.

Merchant Outlet Country and Transaction Currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is ZAR (South African Rand).

INDEMNITY

To the full extent permitted by law, you agree to defend, indemnify us and hold us and our officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers and employees harmless from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including attorneys’ fees) arising from your use of and access to the Website and/or the Products; your violation of any term of these Terms; your violation of any third-party right, including, without limitation, any copyright, trade mark, trade secret, or other property or privacy right; or any claim that your Content caused damage to a third party.

This defence and indemnification obligation will survive termination, modification or expiration of these Terms and your use of the Products and the Website.

LIMITATION AND TERMINATION OF PRODUCTS

You acknowledge and agree that we, in our sole and absolute discretion, have the right (but not the obligation) to delete or deactivate your account, block your e-mail or IP address, or otherwise terminate your access to or use of the Products (or any part thereof), immediately and without notice, for any reason including our belief that you have violated these Terms. You agree that we will not be liable to you or any third party for termination of your access to the Website or the Products. You also agree not to attempt to use the Products after such termination.

DISCLAIMER OF WARRANTIES

You expressly acknowledge and agree that use of the Website and the Products is entirely at your own risk and that the Website and the Products are provided on an ‘as is’ or ‘as available’ basis, without any warranties of any kind. All express and implied warranties, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights, are expressly disclaimed to the fullest extent permitted by law. As with the purchase of a product or service through any medium or in any environment, you should use your best judgement and exercise appropriate caution.

To the full extent permitted by law, neither we or our officers, directors, employees or agents will be liable for direct, indirect, incidental, special, consequential or exemplary damages (even if we have been advised of the possibility of such damages) resulting from any aspect of your use of the Website or the Products, including damages arising from the use or misuse of the Website or the Products, from the inability to use the Website or the Products, or from the interruption, suspension, modification, alteration, or termination of the Website or the Products. These limitations will apply to the fullest extent permitted by law.

ASSIGNMENT

These Terms and any rights and licences granted hereunder may not be transferred or assigned by you but may be assigned by us without restriction. Any assignment or transfer by you will be null and void.

ABILITY TO ACCEPT TERMS OF PRODUCTS

If you are under the age of 18 years, you possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations and warranties set forth in these Terms and to abide by and comply with these Terms.

SEVERABILITY

If any provision of these Terms is held to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions of the Terms will not in any way be affected or impaired.

SUCCESSORS AND ASSIGNS

These Terms will inure to the benefit of and be binding upon each party’s successors and assigns.
